Update My Property Terms of Use

Purpose

This free Service is provided to you to help you improve the details that are held by QV about your home. QV intends to use and disclose information you provide through your use of the Service to perform valuation services for your council and to provide other property related services and products.

As some changes to a property do not require a building consent, and are not visible with an external inspection, the information submitted by you helps to keep the district valuation roll and QV data up to date.

Your use of the Service and your responsibilities

You may use the Service to provide QV with information about a property if you are the property owner or authorised to provide that information by the property owner. You agree that:

• You will only provide QV with accurate information in respect of a property.
• You may be contacted by QV in response to any information you provide.
• QV is not obliged to update your property information in response to any information that you provide.

You agree not to use the Service or information obtained through the Service for any of the following purposes or functions:

• As a tool in connection with lending purposes.
• As a tool in connection with the purposes of property valuations.
• As a registered valuer's report for the purposes of the Trustee Act 1956.

You agree to only use information available through the Service to check the details on your property and provide any updates, photos or information that are relevant to it. You will comply with QV’s instructions in relation to the Service and won’t do anything that adversely affects the Service or the Service’s use by anyone else.

If you obtain information through your use of the Service, your collection of such information must be for a lawful purpose and your handling of the information must comply with all laws (including the Privacy Act). You agree that you will not use or disclose any information obtained through your use of the Service:

• To create any mailing or address list of persons or properties.
• For telemarketing, spam or other unsolicited communications.
• In a commercial product.

You must not resell or transfer any data from this service for valuable consideration and you must not allow any data in the Service to be indexed by any public internet web search engine or bulk harvested.

Intellectual Property

All trademarks, trade names, copyrights, patents and other intellectual property rights used in connection with or embodied in the Service (Intellectual Property Rights) will be and remain QV’s or its licensor’s sole property.

You warrant that you are authorised to provide to QV any information which you provide to QV through your use of the Service and you grant QV a non-exclusive, perpetual, irrevocable, transferable and sub-licensable right to exercise all intellectual property rights in any information you provide to QV. Governing law and jurisdiction

Your use of the Service is governed by New Zealand law, and these terms and conditions are governed by and will be interpreted according to New Zealand law. You expressly submit to the non-exclusive jurisdiction within New Zealand.

Privacy & Security

Any personal information collected and held by QV will be used for the purpose of providing the Service or other QV services and products. Under the Privacy Act 1993, you have the right of access to and correction of your personal information held by QV. Electronic Messages

You consent to receive electronic communications from QV by email sent to you at the email address listed on your account. You acknowledge and agree that any electronic communication in the form of such email shall satisfy any legal requirement that such communication be in writing.

Disclaimer

From time to time the Service will be unavailable or its use will be limited because of maintenance or other work that is being undertaken.

The Service is provided on an "as is" and "as available" basis and the use of it is at your sole risk.

QV does not represent or warrant that the information in the Service will be accurate or that the Service will be secure, reliable, uninterrupted or error free or always available (including at a certain speed) or that it will be compatible with the type and version of operating system or browser installed on the device being used or for use in any specific technical environment or that any problems can or will be corrected.

Liability and Indemnity

QV as well as its respective suppliers, contractors, employees, directors, shareholders and agents, will not be liable to you or any third party for any losses or damages suffered by you or any third party as a result of your use of the Service.

You have sole responsibility for all use of the information supplied to you by QV and you indemnify and hold harmless QV against any liability or loss arising from your use of the Service and any liability or loss arising from QV’s use of any information obtained from you through your use of the Service.

Modification of Terms and consistency with other Terms

The Service and these terms and conditions of use may be changed by QV at any time by QV posting the revised terms and conditions on its website. These changes will only apply going forward and you should check terms for changes.

If other terms or conditions agreed between you and QV are inconsistent with these terms (and the exact clauses of these terms have not been explicitly referred to and amended or removed by agreement between QV and you) then you agree that these terms override and take precedence over the inconsistent conditions and terms.
